County tables changes to proposed settlement in rip rap removal case

County officials may be nearing a legal settlement with a rural resident who installed erosion control measures in a public right of way. The settlement was on the Winneshiek County Board of Supervisors’ Tuesday agenda, but the board took no action, after reconsidering the details of the proposed agreement. The board indicated the issue would be taken up again during its next meeting.

“This has been ongoing for quite a while, so one more week, I don’t believe it’s going to throw a wrench in anything,” Supervisor Chair Dan Langreck said.

Landowner Jeffrey Peel filed a petition against the Winneshiek County Board of Supervisors in mid-December of 2023, alleging the board acted illegally by instructing him late last year to remove the materials, which he had placed in the county right of way near his home along 360th Street. 

A draft of the proposed agreement shows Peel would be asked to remove a portion of the measures he put in place, dismiss the case against the county and pay court costs.
